These terms cover two different things. Most of this page applies when you buy a fob, a mobile eFob, or an eFob reissue through a building storefront operated by Fobmo. The last section applies instead if you are a trade business subscribing to Operate. They are written in plain English. If anything is unclear, please email admin@fobmo.com before you buy or subscribe.
Who is selling, and who is fulfilling
Fobmo operates the storefront for your building on behalf of the building's owners corporation (the "OC"). When you place an order, the OC's manager fulfils it: they post a physical fob, or they provision a mobile credential against the building's access control system.
Fobmo's role is the technical platform and the payment route. Your order is for goods supplied by the building (a credential that works at the building's doors); Fobmo facilitates the transaction.
For convenience, "we" in these terms refers to Fobmo. "You" means the buyer.
What we sell
The storefront sells three product types. Your building's OC manager chooses which to offer and sets the price.
- Access fob. A physical fob, posted to the address you provide.
- Mobile eFob (new). A digital credential provisioned to your phone by the building's OC manager.
- Mobile eFob (reissue). A replacement digital credential for one that was lost, stolen, or deactivated.
Eligibility
Storefront products are sold only to people who are eligible for access at the building (typically owners, tenants, and authorised occupants). When the OC manager fulfils your order, they confirm your eligibility against the building's records. If you are not eligible, the OC manager may reject the order and refund your payment.
Pricing and payment
Prices are set by the building's OC manager and displayed in Australian dollars (AUD), inclusive of any applicable Goods and Services Tax (GST). The price you see on the storefront is the total you pay; there is no separate shipping or handling charge at v1.
Payments are processed by Stripe. When you click Pay you are taken to a Stripe-hosted payment page; your card details are entered there, not on Fobmo's servers. Your contract for payment processing is with Stripe and is governed by Stripe's Consumer Terms.
Fulfilment
After you pay, the building's OC manager reviews and confirms your order, then fulfils it.
- Physical fobs are posted via Australia Post to the address you provide. Typical delivery is a few business days from confirmation; we do not commit to a specific delivery window.
- Mobile eFobs are provisioned manually by the OC manager. You will receive an email with setup instructions once your credential is ready, typically within a few business days.
Fobmo is not the carrier and is not the credential issuer. We are not responsible for delays caused by Australia Post, by the building's access control system, or by other factors outside our reasonable control.
Cancellations and refunds
Refunds at v1 are at the OC manager's discretion. If your order is rejected (for eligibility, for a duplicate order, or for any other reason the OC manager records), your payment will be refunded in full via Stripe. Refunds typically appear in your account within 5 to 10 business days.
If you want to cancel an order before fulfilment, email admin@fobmo.com as soon as possible. We will pass the request to the OC manager. Once a physical fob has been posted or a mobile credential has been provisioned, cancellation is not possible.
Your statutory rights under the Australian Consumer Law are not affected by these terms.
After delivery
Once a fob is in your possession or an eFob is provisioned to your device, it is your responsibility to keep it secure. Fobmo is not liable for unauthorised access caused by a fob that you lost, lent, or had stolen. If you lose a fob or your phone, contact the building's OC manager (or Fobmo at admin@fobmo.com) so the credential can be deactivated.
Account, login, and personal data
The storefront does not create an account or a password for you. Your order is keyed to the email address you provide. Personal information you give us (name, email, mobile, shipping address) is governed by our Privacy Policy.
Acceptable use
You agree not to:
- Place an order for someone else without their permission.
- Provide false identity or address details.
- Use a credential to give building access to people who are not authorised by the OC.
- Attempt to interfere with the storefront, the payment flow, or the access control system.
If we believe an order is fraudulent or violates these terms, we may reject it and refund the payment.
Service availability
Fobmo provides the storefront on an as-is basis. We aim for high availability but we do not guarantee uninterrupted service. Scheduled maintenance, payment provider outages, and other events outside our reasonable control may temporarily prevent orders.
Fobmo or the building's OC manager may discontinue the storefront, remove any product, or end sales for a building at any time. Orders already placed and paid for will be honoured or refunded.
Liability
To the extent permitted by law, Fobmo's total liability to you in connection with the storefront, an order, or these terms is limited to the amount you paid for the order in question.
Fobmo is not liable for indirect, consequential, or incidental losses, including loss of access while a credential is being shipped or provisioned, lost time, or third-party costs.
Nothing in these terms limits or excludes any rights you have that cannot be limited or excluded under the Australian Consumer Law or any other applicable law.
Operate subscriptions (for trade businesses)
This section applies if you are a security installer, facilities firm, building manager, or integrator subscribing to Operate for a building. It does not apply to fob buyers, and nothing above it changes because of it.
What you are subscribing to
Operate is a subscription per building, paid monthly in advance. There are two tiers, both in Australian dollars and both inclusive of GST:
- Operate, $19 per building per month. Fobmo reads your Inner Range Inception controller each night, keeps its configuration and its access events beyond the controller's own rolling buffer, and gives you and the people you invite a single place to see who holds access and where the records disagree.
- Operate plus Storefront, $49 per building per month. Everything above, plus a storefront for that building where residents order fobs.
The first 30 days are free. We ask for a card when you subscribe and do not charge it until the trial ends. You may cancel at any time; cancelling takes effect at the end of the period you have already paid for, and we do not pro-rate a part month.
What we do to your controller, and what we do not
Fobmo only ever reads your Inception. We do not create, change, or delete anything on it. Please connect Fobmo using a read-only API user; that is all we need, and it is the access we ask you to give us. You are telling us, when you connect a controller, that you are authorised by whoever is responsible for that building to connect it and to let Fobmo hold its records. If that stops being true, tell us and we will stop.
Because we do not write to the controller, we cannot switch a credential off for you. Separately, under Australian strata law neither an owners corporation nor Fobmo can cancel a lot owner's fob without the owner asking. That is a legal limit on everybody, not a gap in our product.
Fob sales, if you are on the storefront tier
Fobmo is the seller for every storefront order and takes the payment. You keep 75% of the retail price of each fob sold through your building's storefront, and we settle with you monthly against a statement showing each order. You supply and program the credential. The building's owners corporation manager sets the prices and confirms or rejects each order, so an order is not yours to fulfil until they confirm it. Refunds are handled by us, by hand.
The records, and what happens when the owners corporation subscribes
The building's access records belong with the building, not with whoever is currently operating it. If you stop subscribing, we keep the building's records and you lose access to them; we do not delete a building's history because a subscription ended. If the owners corporation later subscribes to Govern for the same building, your access continues and the two of you see the same records, with the owners corporation's own records taking precedence where they disagree.
Personal information in those records is handled as described in our privacy policy. You may see the people and credentials for buildings you operate; you may not see anything for a building you do not.
Service, and what we do not promise
We do not promise an uptime figure. We poll your controller nightly rather than continuously, so what you see reflects the last successful read, and a controller that is offline or a credential that has been changed will show us as out of date until the next one. Operate is a record and a check, not a monitoring or alarm service, and it is not a substitute for your own access control system.
Changes to these terms
We may update these terms from time to time. The "Effective" date at the top reflects the current version. For material changes, we will also note the change at the top of this page for at least 30 days. The terms that apply to your order are the ones in force at the time you placed it.
Governing law
These terms are governed by the laws of New South Wales, Australia. Any dispute that cannot be resolved by talking with us will be determined by the courts of New South Wales, Australia.
